Full Payment

Full payment for your BTR tour must be processed by PayPal account within 30 days of your trip date. Registrations taking place within the final 30 days prior to your trip date will require payment in full to PayPal account.

Cancellations

Cancellations in writing made before 30 days of your trip date, will result in refund of your trip fee less a $300 per person processing fee. Cancellations made within the final 30 days prior to your trip date will result in full refund, less a $600 per person processing and handling fee. If you must cancel within 10 days of your trip start date a $1500 refund will be credited to you.

If in the event BTR is cancelled for any reason; B.E.W. will refund any payment made by you for your participation in Bici Tre Regioni. This payment will constitute complete settlement between you and B.E.W.

B.E.W. does not assume any responsibility for loss to you in regard to airline tickets purchased and/or other miscellaneous items that may have been purchased. B.E.W. advises you to obtain trip cancellation insurance in order prevent loss based on unforeseeable events.

Release and Waiver of Liability, Assumption of Risk and Indemnity Agreement

Please read the following release and waiver (the "Agreement") carefully before signing. In consideration for joining a BIKE EAST & WEST LLC (B.E.W. LLC). tour/bicycle vacation, you agree to the terms of the following agreement relating to the tour/vacation as (BICI TRE REGIONI - BIKE THREE REGIONS - BTR offered by B.E.W.)

I acknowledge, agree and represent that I understand the nature of the activities, and that the activities of BTR are designed and intended for cyclists with significant cycling and bicycle handling experience, and that I have such experience. I am physically fit and have sufficiently trained/practiced for participation in these activities, and have not been advised otherwise by qualified medical personnel. I further understand and acknowledge that these bicycle rides will be conducted over public roads, bridges, and facilities open to the public upon which the hazards of traveling are to be expected. I agree to ride in a safe manner obeying all of the traffic rules of the road. If at any time I believe conditions to be unsafe, I will immediately discontinue further participation until deemed reasonably safe for riding activities.

I acknowledge and fully understand that bicycling is an extreme test of a person's physical and mental limits and involves risks of potential for serious bodily and emotional injury including permanent disability, paralysis and death, and property and economic loss (the "Risks"). These Risks and dangers may be caused by my own actions, or inaction, the action or inaction of others participating in the activity, or the conditions in which the activities take place. These Risks may not be known to me or not readily foreseeable at this time; and I FULLY ACCEPT AND ASSUME ALL SUCH RISKS AND ALL RESPONSIBILITY FOR LOSSES, COSTS AND DAMAGES incurred as a result of my participation in the activities afforded by B.E.W. I HEREBY ASSUME THE RISKS RELATED TO AND ARISING OUT OF PARTICIPATING IN BICYCLING AND ALL THE ACTIVITIES AFFORDED WHILE ASSOCIATED WITH BTR. I acknowledge that this Agreement will be used by B.E.W. LLC. in return for permitting me to participate in the BTR activites, I hereby take action for myself, my executors, administrators, heirs, next of kin, successors and assign ("the Releasors") as follows: (a) THE RELEASORS WAIVE, RELEASE, DISCHARGE, AND AGREE NOT TO SUE FROM ANY AND ALL LIABILITIES OR CLAIMS, DEMANDS LOSSES, OR DAMAGES ON MY ACCOUNT CAUSED OR ALLEGED TO BE CAUSED IN WHOLE OR IN PART BY THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, INCLUDING BUT NOT LIMITED TO NEGLIGENT RESCUE OPERATIONS AND/OR NEGLIGENT BICYCLE MAINTENANCE OR REPAIR, for my death, disability, personal injury, property damage, property theft or action of any kind which may hereafter accrue to me as a result of my participation in, or my traveling to and or from the BTR, THE FOLLOWING ENTITIES: BIKE EAST & WEST and RIDE LEADERS in both their individual and corporate capacities and their respective administrators, directors, agents employees, and other participants, any sponsors, advertisers, and if applicable, owners and lessors of premises on which the activities of BTR take place (collectively, the "Releasees"); (b) THE RELEASORS INDEMNIFY AND HOLD HARMLESS BIKE EAST & WEST., the RIDE LEADERS and the Releasees against all claims and liabilities made by other individuals or entities as a result of any of my actions during or arising out of the activities. I agree to indemnify the Releasees in the event of a claim by someone, such as a spouse, who suffers a loss because of my participation in the activities afforded by BEW/ BTR.

I agree that BIKE EAST& WEST LLC. and the RIDE LEADERS are not responsible for providing medical care for participants in the activities. I understand and agree that in case of medical emergency, every reasonable effort will be made to insure the health and well-being of participants by contacting emergency medical personnel. The cost of emergency medical treatment, including transportation, will be the responsibility of individual participants. I understand that there may be a limitation to evacuation facilities in Italy.

B.E.W. / BTR retain the right to disqualify anyone at any time during the trip if they feel it is medically necessary or in the interest of the safety of the group or any participants. Refunds are not given under such circumstances. BIKE EAST & WEST has mandated the use of approved well fitting and properly secured helmets at all times while cycling.

I agree that it is my responsibility to make certain and confirm that all necessary visa, and passport documentation is valid and current in regard to travel between my nation of citizenship and the Republic of Italy.

I agree to wear a US CPSC approved bicycle helmet at all times while riding in BTR.

I agree that I have been advised, and that it is my responsibility to seek and obtain trip cancellation insurance. I understand that circumstances beyond the control of B.E.W. in regard to international foreign travel that it may become necessary for B.E.W. to cancel my trip, and this Agreement based on heretofore unseen travel restriction.

I agree to allow B.E.W. LLC / BTR to use any photographs, videos of me or written or oral comments made by me in connection with any advertising or publicity for B.E.W. / BTR without compensation. I agree not to distribute, share, recreate, reuse, reproduce or publish, in any manner or medium, any B.E.W. / BTR copyrighted materials, including but not limited to bike routes, maps and information mailed pre or post ride/vacation. This agreement shall be governed by the laws of the State of Michigan. I hereby certify that I have read this Agreement and I FULLY UNDERSTAND ITS CONTENTS AND TERMS. I FURTHER UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT AND HAVE SIGNED IT FREELY AND WITHOUT INDUCEMENT OR ASSURANCE OF ANY NATURE, AND INTEND IT TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW AND AGREE THAT IF ANY PORTION OF IT IS HELD TO BE INVALID, THE BALANCE NOTWITHSTANDING, SHALL CONTINUE IN FULL FORCE AND EFFECT. This Agreement may be modified only in writing.
